Introduction

This policy (“Privacy Policy”) describes how Plurality Digital Inc. d.b.a. Shoplift (together with its affiliated companies - “Shoplift”, “we”, “us” and/or “our”) may collect, use, disclose, and otherwise process user data when you visit https://www.shoplift.ai/ (“Website”) or use our application and associated platforms (our “Application” and together with the Website, our “Services”). 

CCPA NOTICE: We adopt this notice to comply with the California Consumer Privacy Act of 2018 and all amendments (“CCPA”). Any terms defined in the CCPA have the same meaning when used in this Privacy Policy.

This Privacy Policy applies to information we collect: 

  • On our Services. 
  • In email, text, and other electronic communications between you and our Services. 

This Privacy Policy does not apply to information collected by: 

  • Us offline or through any other means, except as otherwise provided through our Services. 
  • Any third party, including through non-Shoplift applications or content (including advertising) that may link to or be accessible from or on our Services. 

Please review this Privacy Policy carefully, and please use the information herein to make informed choices. By accessing or using our Services, you agree to this Privacy Policy. This Privacy Policy may change from time to time (see Changes to Shoplift’s Privacy Policy). Your continued use of our Services after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates. The last time this Privacy Policy was reviewed and updated is listed at the top of this page. If you have any concerns or questions about our privacy practices, please feel free to contact us (see How to Contact Us).

If you do not agree to this Privacy Policy or our practices, do not access or use our Services.

You are not legally required to provide us with any personal data. If you do not wish to provide us with your personal data, or to have it processed by us or any of our service providers, please do not provide it to us and avoid any interaction with us or with any portions of our Services.

Information We Collect 

The term “Personal Information” in this Privacy Policy refers to information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to an individual. It does not include aggregated or anonymized information that is maintained in a form that is not reasonably capable of being associated with or linked to an individual.

We collect the following categories of Personal Information, with respect to the following types of data subjects:

User Data: Personal Information concerning customers’ organizational account details and users of the platform on behalf of such customers, as well as the customer’s business needs and preferences, as identified to us or recognized through our engagement with them.

●  Prospect Data: Personal Information relating to visitors of our websites, participants at our events, and any other prospective customer, user or partners who visit, purchase, or otherwise interact with our Services.

Specifically, we collect or generate the following types of Personal Information about such individuals through our Services:

● Usage and device information concerning customers, users, and prospects (such as connectivity, technical and aggregated usage data, such as user agent, IP addresses and approximate location based upon such IP addresses (geolocation), device data (like type, operating system, device ID, browser version, locale and language settings used), activity logs (including cloud logs), session recordings, website chat feature data, log-in credentials to the Services, the cookies and pixels installed or utilized on their device, and inferred or presumed data generated from users’ use of the Services;

●  Information concerning our customers, users and prospects, such as contact and business details including name, email, phone number, position, workplace, and professional information, related business insights, our communications with such individuals (and any analyses thereof), feedback and testimonials received, as well as any expressed, presumed, or identified needs, preferences, attributes, and insights relevant to our potential or existing engagement, purchasing details including interest and/or purchase history and commercial information, including records of our products or services purchased, obtained, or considered.

For the purposes of the California Consumer Privacy Act ("CCPA"), in the past 12 months, we have collected the following categories of personal information, as defined in the CCPA: identifiers; personal information listed in the California Customer Records statute; customer record information; Internet or other electronic network activity information; commercial information; audio, electronic, visual, thermal, olfactory information; and inferences drawn from other personal information. 

We have collected such Personal Information from the following sources:

• Automatically, when you use our Services.

• Merchants and Users. 

• Service providers. 

How We Use Personal Information

We use information that we collect about you or that you provide to us, including any Personal Information, to: 

  Present our Services and their contents to you. 

●  Satisfy the purpose for which the Personal Information was provided, or in any other way we may describe when you provide the information.

●  Communicate with individuals, including via email, text message, push notification, social media and/or telephone calls.

●  Provide you with access to the requested product or services and to monitor your use of such product or services.

●  Operate, maintain, and provide the features and functionality of the Services.

●  Help us improve the content and functionality of our Services to better understand our users and to improve the Services we provide.

●  Market to individuals or contact individuals in the future to tell them about products or services we believe will be of interest to them.  If we do so, each marketing communication will contain instructions permitting you to “opt-out” of receiving future marketing communications.  In addition, if at any time you wish not to receive any future marketing communications or you wish to have your name deleted from our mailing lists, please contact us (see How to Contact Us).

●  Personalize experiences and deliver custom content and product and service offerings relevant to an individual’s interests, including targeted offers and ads through our Services or third-party sites.

●  Recognize an individual and remember their information when they return to our Services.

●  Help maintain the safety, security, and integrity of our property and Services.

●  Improve, test, enhance, update, and monitor our Services or to diagnose or fix technology problems. 

●  To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including our Terms of Service.

●  For any other purpose with your consent.  

Retention of Personal Data

We retain Personal Information for as long as we deem it as reasonably necessary in order to maintain our relationship and provide you with our Services and offerings; in order to comply with our legal and contractual obligations; or to protect ourselves from any potential disputes (i.e., as required by laws applicable to log-keeping, records and bookkeeping, and in order to have proof and evidence concerning our relationship, should any legal issues arise following your discontinuance of use).

To determine the appropriate retention period for Personal Information, we consider the amount, nature, and sensitivity of the data, the potential risk of harm from unauthorized use or disclosure of your Personal Information, the purposes for which we process the data, and applicable legal requirements.

Please note that except as required by applicable law or our specific agreements with you, we will not be obligated to retain your Personal Information for any particular period, and we are free to securely delete, anonymize, or restrict access to it for any reason and at any time, with or without notice to you.

Disclosure of Your Information

Within Shoplift: Shoplift entities may disclose Personal Information to other Shoplift entities for purposes and uses consistent with this Privacy Policy.

Service Providers:  Shoplift may sometimes employ third parties and service providers to provide services on our behalf to our Services users. We may need to share your information with service providers to provide information about products or services to you. Examples may include removing repetitive information from prospect lists, analyzing data or performing statistical analysis on your use of the Subscription Service or interactions on our websites, providing marketing assistance, supplementing the information you provide us in order to provide you with better service, developing and improving the product and services, and providing customer service or support. These service providers are prohibited from using your Personal Information except for these purposes, and they are required to maintain the confidentiality of your information.

With Third-Party Widgets: If you click on a widget or social media feature, like the Facebook “like” button, these widgets will share information with the widget provider (like IP address or which portion of the Services you are accessing) and may set a cookie to enable the feature to function correctly. If such widgets direct you to third-party sites, we are not responsible for the information collection and use practices thereof. Your interactions with and visits to third-party sites and applications are governed by the respective privacy policies of such platforms.

Your Employer:  If you are using the Services in connection with your role as an employee or contractor of a company or other legal entity, we may share your information with such entity.

Legal Requirements:  Shoplift may disclose your Personal Information if required to do so by law or in the good faith belief that such action is necessary to: (i) comply with a legal obligation or with applicable law, court order, or governmental regulation, including to respond to any government or regulatory request; (ii) to enforce or apply our Terms of Service and other agreements to which Shoplift is a party; or (iii) if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Shoplift, our customers, or others.

Third Parties in the Context of a Corporate Transaction:  We may disclose Personal Information as reasonably necessary to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Shoplift’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Shoplift about our Services users is among the assets transferred. 

We do not sell or share personal information, as such terms are defined by CCPA.

Automatic Data Collection Tools

What We Collect:

As you navigate through and interact with our Services, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including traffic data, location data, cloud logs, communication data, and information about your computer and internet connection, including your IP address, operating system, and browser type. We use the following tools for automatic data collection: 

Cookies

A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you disable cookies be advised that you may be unable to access certain parts of our Services. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Services. 

We use the following types of cookies:

●  Strictly necessary cookies. These cookies enable core functionality such as security, network management and accessibility. You may disable these by changing your browser settings, but this may affect how the websites and online portions of our Services function. 

●  Personalization cookies. These enable a website to remember information that changes the way the website behaves or looks, like your preferred language or the region that you are in. If you are accessing our Services with a European IP address, you have been asked to consent to the use of these cookies. You are free to deny your consent.

●  Analytical/performance cookies. These cookies allow us to recognize and count the number of visitors to our Services, and to see how visitors move around when they are using them. This helps us to improve the way our Services works, for example, by ensuring that users are finding what they are looking for easily. If you are accessing our websites with a European IP address, you have been asked to consent to the use of these cookies. You are free to deny your consent.

●  Marketing cookies. These cookies record your visit to our Services, the pages you have visited and the links you have followed. They are used to track visitors across our Services. We will use this information to make our Services and the advertising displayed on it, as well as the marketing messages we send to you, more relevant to your interests. We may also share this information with third parties who provide a service to us for this purpose. If you are accessing our websites with a European IP address, you have been asked to consent to the use of these cookies. You are free to deny your consent.

Web Beacons

Pages of our Services and email communications may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit us to track traffic on our Services, for example counting users who have visited certain pages or opened an email or recording the popularity of certain content. 

Third-Party Use of Automatic Collection Tools: 

Some content or applications, including advertisements, on our Services are served by third parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies, alone or in conjunction with other tracking tools, to collect information about you when you use our Services. The information collected may be associated with your Personal Information or they may collect information, including Personal Information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based advertising or other targeted content. 

We do not control these third parties’ tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly. 

How We Use Information Collected Automatically:

We use or may use the data collected through automatic data collection tools to: (a) remember information so that an individual will not have to re-enter it during their visit or the next time they use our Services; (b) provide and monitor the effectiveness of our Services, including marketing communications; (c) monitor aggregate metrics such as total number of visitors, traffic, and usage on our Services; (d) diagnose or fix technology problems; (e) understand browsing activities on our Services and across third-party platforms; and (f) otherwise to plan for and enhance our Services.

Choices About Cookies:

You can set your browser to refuse cookies or to alert you when cookies are being sent. To manage cookies, an individual may change their browser settings to: (i) notify them when they receive a cookie, so the individual can choose whether or not to accept it; (ii) disable existing cookies; or (iii) set their browser to automatically reject cookies.  Please note that doing so may negatively impact an individual’s experience using our websites, as some features on our Services may not work properly.  Depending on an individual’s device and operating system, they may not be able to delete or block all cookies.  In addition, if an individual wants to reject cookies across all their browsers and devices, they will need to do so on each browser on each device they actively use.  An individual may also set their email options to prevent the automatic downloading of images that may contain technologies that would allow us to know whether they have accessed our email and performed certain functions with it.

Online Advertising

What We Collect and How We Use It:

We participate in interest-based advertising and use third-party advertising companies to serve targeted advertisements based on an individual’s browsing history.  We permit third-party online advertising networks, social media companies, and other third-party services, to collect information about an individual’s use of our Services over time so that they may play or display ads on other websites, or services an individual may use, and on other devices an individual may use. The collection and use of information by third-party cookies may be limited by certain operating systems and/or browsers. Typically, though not always, the information used for interest-based advertising is collected through data collection technologies, such as cookies, embedded scripts, location-identifying technologies, and similar technology which recognize the device an individual is using and collect information, including click information, browser type, time and date the individual visited the website, AdID, precise geolocation, and other information.  We may share a common account identifier (such as a hashed email address or user ID) with our third-party advertising partners to help identify an individual across devices.  We and our third-party partners use this information to make the advertisements an individual sees online more relevant to their interests, as well as to provide advertising-related services such as reporting, attribution, analytics, and market research.

Choices About Online Ads:

We support the self-regulating online interest-based advertisements on their internet browser from advertisers and third parties that participate in the Data Advertising Alliance (“DAA”) program and perform advertising-related services for us and our partners, regulatory principles for online behavioral advertising (“Principles”) published by the DAA. This means that we allow an individual to exercise choice regarding the collection of information about their online activities over time and across third-party websites for online interest-based advertising purposes.  More information about these Principles can be found at www.aboutads.info. If an individual wants to “opt out” they can follow the instructions.

When electing to opt-out through these sites, they will place an “opt-out” cookie on your device indicating that you do not want to receive interest-based advertisements.  Opt-out cookies only work on the internet browser and device they are downloaded onto.  If an individual wants to opt-out of interest-based advertisements across all browsers and devices, they will need to opt-out on each browser on each device they actively use.  If an individual deletes cookies on their device generally, they will need to opt-out again.

If an individual wants to “opt out” of receiving online interest-based advertisements on mobile apps, they should follow the instructions at http://www.aboutads.info/appchoices.

Please note that when an individual “opts-out” of receiving interest-based advertisements, this does not mean they will no longer see advertisements from us.  It means that the online ads that an individual does see from DAA program participants should not be based on their interests.  We are not responsible for the effectiveness of, or compliance with, any third-parties’ opt-out options or programs or the accuracy of their statements regarding their programs.  In addition, third parties may still use cookies to collect information about an individual’s use of our Services, including for analytics and fraud prevention as well as any other purpose permitted under the DAA’s Principles.

Your Privacy Rights and Choices

You may opt out of receiving marketing emails from us by following the instructions in those emails or by emailing us at help@shoplift.ai.

If you are a resident of the EU, UK, California, or another jurisdiction with an applicable privacy law, you may have certain rights available to you. These rights may include:

The right to be informed about our data collection practices;

The right to access and rectify or correct your data;

The right to erase or delete your data;

The right to data portability;

The right to restrict and object to the processing of your data (including for direct marketing purposes);

The right to opt out of the sale of your information;

The right to opt out of marketing emails and text messages;

The right to limit our use of any automated decision-making processes;

The right to lodge a complaint to your local data protection authority, and;

The right to withdraw consent (to the extent applicable).

The information that we collect through or in connection with the Services is transferred to and processed in the United States for the purposes described above. Shoplift also may subcontract the processing of your data to, or otherwise share your data with, affiliates or third parties in the United States or countries other than your country of residence. The data protection laws in these countries may be different from, and less stringent than, those in your country of residence. By using the Services or by providing any personal or other information to us, you expressly consent to such transfer and processing.

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights or data subject rights under other jurisdictions’ laws. Unless permitted by the CCPA, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

GDPR

In compliance with the European Union (“EU”) General Data Protection Regulation (“GDPR”), we may rely upon one or more legal bases defined in the GDPR to collect, use, share, and otherwise process the Personal Information of individuals located in the EU, including where: 

  • Necessary to perform a contract we have with you. 
  • You have consented to the processing (in which case you may revoke your consent at any time). 
  • Necessary for us to comply with a legal obligation, or to establish, exercise, or defend legal claims. 
  • Necessary for the purposes of Shoplift’s or a third party’s legitimate interests, such as providing and maintaining our Services, provided that those interests are not overridden by your interests or fundamental rights and freedoms. 

Where we collect, use, disclose and otherwise process your information based on legitimate interests, we may rely on the following interests:

  • Marketing our products: We use your information as necessary to pursue our legitimate interests in marketing our products to you. For example, where permitted by digital marketing law, we may contact you by email to let you know of products you might be interested in.
  • Providing, improving and developing our products: We use your information as necessary to pursue our legitimate interests in tailoring and improving our products. For example, we may send you a survey or questionnaire to understand your experience in purchasing from us.

Non-Personal Information

Data from Shopify APIs: With your consent, upon installing Shoplift from the Shopify App Store, Shoplift sends and receives certain data to and from your Shopify storefront using the Shopify GraphQL Admin API and Webhooks, including but not limited to the Theme Object, Assets Object, Products Object and Orders Object, allowing Shoplift to provide core features, such as A/B testing, conversion optimization analysis, app blocks, and custom sections. Shoplift is unable to be used without access to the Shopify Admin API objects listed herein. The data collected from Shopify’s APIs does not under any circumstance include personally identifiable information related to any user: specifically, a user’s first name, last name, email address, phone number, or street address.

Children

Our Services are not intended for children under 18 years of age, or the age of majority in your jurisdiction. No one under age 18 may provide Personal Information to or on our Services. We do not knowingly collect Personal information from children under 18. If you are under 18, do not use or provide any information to our Services or through any features therein, including your name, address, telephone number, email address, or any screen name or user name. If we learn we have collected or received Personal Information from or about a child under 18, please contact us at help@shoplift.ai.

Changes to Shoplift’s Privacy Policy

Shoplift may make changes to the Services in the future and as a consequence will need to revise this Privacy Policy to reflect those changes. Shoplift will post all such changes on the Site, so you should review this page periodically. The date the Privacy Policy was last revised is identified at the top of the page. You are responsible for periodically visiting this page and reviewing our Privacy Policy to check for any changes. 

Data Security

Shoplift takes reasonable steps to protect your Personal Information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction, taking into account the risks involved in the processing and the nature of the Personal Information. However, no application, Internet, or email transmission is ever fully secure or error-free, and we do not guarantee the security of any Personal Information. You are also responsible for ensuring that your account and the passwords we provide you are protected. We are not responsible for circumvention of any privacy settings or security measures contained within our Services.
